Before an employee can file a discrimination lawsuit against their employer, they must first exhaust all internal remedies the company offers. Then, the worker must file a complaint with the Equal Employment Opportunity Commission or a corresponding state agency such as the Maryland Commission on Civil Rights or the Virginia Division of Human Rights. This is meant to ensure the worker exhausts the available administrative remedies, as well.
On Monday, the U.S. Supreme Court agreed to hear three cases about whether our nation's main civil rights law bars discrimination based on sexual orientation or gender identity. Title VII of the Civil Rights Act of 1964 prohibits discrimination "because of sex," as well as race, color, national origin and religion.
Now that Justice Brett Kavanaugh has been sworn in, there is a full slate of justices on the U.S. Supreme Court. Their new term began Oct. 1, and the court jumped right in to hear oral arguments about an age discrimination case.
