Employment Defense Litigation

Employment lawsuits present an obstacle to businesses trying to make prudent personnel decisions in this challenging economic climate. Regardless of preventative steps that many companies take, litigation is often unavoidable because of former employees' refusal to accept the reality of their terminations. The Thatcher Law Firm understands this and is prepared to help you navigate the EEOC process and the court system. We currently represent multiple entities with more than 15,000 employees, and are well versed in employment litigation defense. Additionally, because many of our lawyers have represented plaintiffs and defendants, we understand the tactics and strategies of plaintiffs' counsel. Our firm is therefore better able to anticipate and defend against their maneuvers than law firms that are exclusively dedicated to defense work.

Our firm's managing partner, Linda Hitt Thatcher, an entrepreneur in her own right, has authored many winning summary judgment motions, having lawsuits thrown out of court, saving employers the expense and aggravation of trial. Winning cases in which the court issued an opinion on Ms. Thatcher's motions include Waldrop v. Science Applications International Corporation, 2011 WL 4025410 (D.Md. Sept. 9, 2011) and Olumoya v. Prince George's County Public Schools, 2010 WL 2696625 (D.Md. July 2, 2010). However, when trials are necessary, our firm has experience in taking more than 100 cases to jury trials and has succeeded in winning high-profile cases in court.

When advocating for our clients, we never lose sight of cost containment. Accordingly, we litigate vigorously, while offering large-scale entities alternative fee arrangements. Unlike larger firms that exclusively bill at high hourly rates, we can work with you to create value-based billing, partner-associate blended rates or hybrid billing structures. We are committed to forming lasting partnerships with general counsels, entrepreneurs and executives. We regularly meet with business entities to find innovative strategies to ensure predictability and reasonableness in legal fees.

If an issue arises in the workplace, we more than likely have dealt with it previously. Most of our time is spent advising clients on how to best handle difficult situations in the workplace before they escalate and turn into serious, expensive problems. To assist our clients in avoiding litigation as well as to take actions in anticipation of litigation, we provide employment law training for staff and develop recommended policies and procedures for personnel.

If employment litigation is filed against an employer, the firm represents management in federal and state courts, and in grievances and arbitrations before administrative agencies and other forums. The firm also represents management in the negotiation of labor contracts and employment agreements for executive personnel.
